By accessing, registering for, or using the Tradewinds platform ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

Your continued use of the Platform constitutes ongoing acceptance of these Terms.

Tradewinds provides educational tools, simulations, content, and resources related to financial literacy, including but not limited to trading simulations, market analysis tools, AI-driven insights, and gamified learning environments.

All activities conducted on the Platform are simulated unless otherwise explicitly stated.

All content, materials, tools, simulations, and information provided on the Platform are for educational and informational purposes only.

Nothing on the Platform constitutes financial advice, investment advice, trading advice, or legal or tax advice.

You acknowledge and agree that any decisions you make based on information from the Platform are solely your responsibility, and you should consult a qualified financial professional before making any financial decisions.

You are solely responsible for your use of the Platform, any decisions or actions taken based on Platform content, and any financial or trading activity conducted outside of the Platform.

Tradewinds does not monitor, control, or influence your actions outside of the Platform.

The Platform may include simulated trading environments, virtual currencies, or hypothetical scenarios.

• Simulated results do not reflect real-world performance.
• Market conditions in simulations may differ from actual markets.
• Success within the Platform does not guarantee real-world success.

To the fullest extent permitted by law, Tradewinds, its owners, operators, affiliates, subsidiaries, partners, licensors, and content providers (collectively, the "Tradewinds Parties") shall not be liable for any damages, losses, or claims arising from your use or inability to use the Platform, any reliance on information provided on the Platform, any trading or financial decisions made by you, outcomes resulting from real-world financial activity, errors, inaccuracies, omissions in content, interruptions, bugs, or technical issues.

This includes, but is not limited to direct, indirect, incidental, consequential damages, and loss of profits or financial losses.

Tradewinds shall not be held responsible or liable for any actions taken by users on or off the Platform, any financial losses incurred by users, any trading behavior influenced by Platform content, or any interactions between users.

You expressly agree that all actions you take are done at your own risk.

The Platform may include content, tools, or integrations provided by third parties, including but not limited to educational partners, financial institutions, or content providers.

Tradewinds does not endorse or guarantee the accuracy of third-party content and does not assume responsibility for third-party services or materials.

Your use of third-party services is at your own risk and subject to their respective terms.

You agree to indemnify, defend, and hold harmless the Tradewinds Parties from and against any and all claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform, your violation of these Terms, or your actions on or off the Platform.

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

Tradewinds makes no warranties or representations, express or implied, including but not limited to accuracy or completeness of content, reliability or availability of the Platform, or suitability for any particular purpose.

By using the Platform, you represent that you have the legal capacity to enter into these Terms.

If you are under the age of majority, you represent that you have obtained parental or guardian consent.

Tradewinds reserves the right to modify these Terms at any time.

Updates will be posted on the Platform, and continued use constitutes acceptance of the revised Terms.

Tradewinds reserves the right to suspend or terminate access to the Platform at its sole discretion, without notice, for any reason.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.

These Terms constitute the entire agreement between you and Tradewinds regarding use of the Platform.
